Employment Litigation
Yarmuth Wilsdon Calfo represents individuals, private companies and public agencies in a wide variety of employment litigation matters including those involving discrimination, retaliation, wage and hour, and non-competition or employment contract disputes. We litigate and try employment cases in state and federal courts in Washington state and throughout the nation.
Recent employment-related litigation includes representation of:
- Colaska, Inc., a subsidiary of Colas, Inc. an international construction firm, in a case alleging violations of the FLSA and Alaska Wage and Hour Act by failing to pay overtime to a high level project manager. The case was dismissed on summary judgment, plaintiff appealed to the Ninth Circuit, and a favorable settlement was reached.
- King County Sheriff’s Office in sexual harassment, negligent supervision and retaliatory discharge claims brought by a police recruit who failed the training program. Case was settled on favorable terms after the Court of Appeals, Division One granted discretionary review of trial court’s denial of motion for summary judgment.
- Cell Therapeutics, Inc., a Seattle biotechnology company, retaliatory termination claim arising out of a False Claims Act investigation. The court dismissed relator’s (plaintiff’s) retaliatory termination claims after the government’s investigation was concluded.
- Representation of IDX Systems Corporation (a subsidiary of GE Healthcare) in a whistleblower retaliatory discharge claim under the False Claims Act. The case was litigated through the district court and Ninth Circuit. The published opinion regarding case can be found at Leon v. IDX Systems Corporation, Inc., 464 F.3d 951 (9th Cir. 2006).
