Seth is a commercial litigator with particular experience in business torts, contract disputes, False Claims Act (whistleblower) litigation, employment litigation, consumer class actions, securities litigation and intellectual property disputes. Seth also represents businesses and individuals in their responses to criminal and administrative enforcement actions by the government.
Some of Seth’s recent cases are:
  • Dootson et al v. Leverett Industries et al:  Defended corporation and its officers in litigation with former shareholders.  The case was settled on favorable terms in June 2008 after the defendants prevailed on several partial summary judgment motions. 
  • FMC Technologies, Inc. v. Edwards et al: Represented defendant manufacturer of food processing equipment in federal court litigation over alleged fraud in prior trade secret litigation.  Obtained summary judgment dismissing plaintiff’s claims in July, 2007.
  • U.S. ex rel Marchese v. Cell Therapeutics Inc., et al:  Represented defendant biotechnology company in defense of False Claims Act litigation alleging Medicare fraud and retaliatory termination.  After settling Medicare fraud allegations with the government, obtained dismissal of relator’s (plaintiff’s) retaliatory termination claims. 
  • CytoLab Pathology Services v. CellNetix Pathology PLLC et al:  Represented plaintiff, a provider of pathology services, in claims for breach of contract and tortious interference with business expectancy arising out of its discharge from Stevens Hospital.  The case was settled on favorable terms in December, 2007.
  • Greenlee v. Fry’s Electronics:  Represented electronics defendant retailer in putative class action alleging deceptive advertising and sales practices.  Obtained dismissal of class action allegations, summary judgment on individual claim, and an award of attorney fees for defendant. 
  • Ledgerwood v. Wenatchee Valley Medical Center, et al:  Represented plaintiff, a physician asserting federal employment discrimination claims.  The case was settled on favorable terms at mediation. 
Before joining Yarmuth Wilsdon Calfo, Seth was a litigation associate at Heller Ehrman, a large commercial law firm.  Seth is a former law clerk to Chief Judge John C. Coughenour of the U.S District Court for the Western District of Washington, and a former extern to Judge Vaughn R. Walker of the U.S. District Court for the Northern District California. 

Seth graduated Magna Cum Laude and Order of the Coif from the University of Michigan Law School, and Phi Beta Kappa from Haverford College. Before law school, Seth served as an honors paralegal in the Antitrust Division of the U.S. Department of Justice.
